Lawyers Get Paid? I Thought They Were There to Help People!

According to Yahoo Sports, a Florida State football player is being sued by his lawyer for an unpaid fee. The player hired a lawyer to represent him in  disciplinary proceedings brought by the University, agreeing to pay a $2,500 fee.  The disciplinary proceeding resulted in a penalty of probation - but no suspension from either school or the team. But the lawyer's fee remains unpaid.

We don't have this problem at UConn.  Students are not allowed to be represented by counsel in disciplinary hearings.  Can anyone say "due process violation?"

This is how our students see the world: Meet Ken.  Ken is in a pickle.  He has a DUI arrest.  But Ken can rest assured that he has found the best lawyer to represent him.  And since this lawyer's ad says nothing about fees, he must be representing Ken for free!

Pay The Piper, or He Sings

From the fable of A-Rod and the MLB:

If you into a serious legal dispute, you need a lawyer.  If you need a  lawyer, then you need to pay a lawyer's fee.  If you don't pay the fee, then you get into a legal dispute with the lawyer who helped you with your legal dispute.  If you get into a legal dispute with the lawyer who helped you with your legal dispute, then your lawyer will disclose all the secrets that he hid for you in order to prove that you needed a lawyer's help with your legal dispute. To try to safeguard those secrets, you will need a lawyer to help you with the legal dispute with the lawyer who helped you with your legal dispute. And the carousel spins round and round again, etc.

The "Business" of Law

While students inherently "know" that lawyers in the private practice of law charge money for the legal services provided, they often do not grasp exactly what that means. The following video shows a family law attorney addressing other lawyers with advice on how to structure fee agreements and collection of fees. I find it serves as a small dose of reality for students.

How do lawyer's charge for their time?
Is litigation cost effective?
What are the pros and cons of hourly billing?

In my opinion, this song helps students become better informed consumers of legal services.
